“Plaintiff’s decision to seek a mistrial in his own case and bring this trial to an end is unusual and telling. We believe that the cross examination regarding risks factors for his injury was appropriate given the evidentiary record in this case, particularly the report and testimony by plaintiff’s own expert. We remain confident that the extensive weight of scientific research and regulatory assessments support the safety of Roundup and that it is not responsible for the plaintiff’s injury.”
