Statement on Evard Appeal

On September 18, 2025, the Illinois First District Appellate Court upheld a jury verdict in favor of Monsanto. In September 2023, Monsanto won a favorable jury verdict in the Evard case in the Circuit Court of Cook County, Illinois before Judge Sandra Ramos. Our statement:

“We are pleased with the court’s ruling that affirms the jury verdict in favor of Monsanto, which is consistent with the extensive body of evidence supporting the safety and non-carcinogenicity of Roundup™. It is also consistent with the weight of scientific evidence demonstrating that low-level exposure to PCBs does not cause NHL.

 

The company has filed a petition for a writ of certiorari with the U.S. Supreme Court in Durnell, a Roundup™ injury case. On June 30, the court requested the opinion of the Solicitor General in this case; once the Solicitor General provides its views, the Supreme Court will then make a decision on the company’s petition during the 2025-2026 court session. If the court accepts the case, a decision on the merits could happen during the court’s next session, which ends in June 2026. The petition argues that a split among federal 9th, 11th and 3rd circuit courts in the Roundup™ personal injury litigation, on the cross-cutting question – including in this case – of whether federal law preempts state-based failure-to-warn theories, warrants review and resolution by the country’s top court. Only the U.S. Supreme Court can provide definitive guidance to state and federal courts that have reached different conclusions on this central issue.”
